Terms & conditions
For using this website, ordering a cake and requesting a table. Your legal rights as a customer are not affected.
1. About these terms
This website is run by [full legal name of the business, e.g. “Le Délice Hither Green Ltd”], trading as Le Délice (“we”, “us”). [If a limited company: registered in England and Wales, company number 00000000, registered office: full address].
Shop address: 232 Hither Green Lane, London SE13 6RT. Email: bonjour@ledelice.co.uk. Phone: 020 8852 5847. [VAT number, if VAT registered: GB 000 0000 00]
These terms apply when you use this website and when you order a cake or request a table through it or by phone. Please read them before you order. If anything here is unclear, ask us before ordering.
2. Using our website
You may use this website for your own personal use. Please do not misuse it, for example by sending spam through our forms or trying to interfere with how it works. We work to keep the website available and accurate, but we cannot promise it will always be available or free from errors.
3. Menu, prices and opening times
Prices on this website are in pounds sterling and include VAT where applicable. Menus, prices, cakes and opening times can change, and items sell out — the price that applies is the one shown in the shop when you buy. Photographs show our food as we make it, but every cake and pastry is made by hand, so yours may look a little different. Bank holiday opening times are posted on our Instagram.
4. Cake orders
How ordering works
- Sending the online form is an enquiry, not an order. Nothing is booked when you send it.
- We will phone or email to confirm what we can make, the price and the collection time.
- Your order is accepted, and a contract formed between us, when you pay the £10 deposit in the shop. The rest of the price is paid when you collect.
- We need at least three days’ notice. We may not be able to accept every request, for example on busy dates.
- Cakes are collected from 232 Hither Green Lane at the agreed time.
Messages and decoration
A short piped message is included free. We may decline messages or designs that are offensive, or that use other people’s trade marks or characters, and we will tell you if so.
Changes and cancellations
If you need to change your order, please tell us as early as possible — we will do our best but cannot guarantee changes close to the collection date.
Because celebration cakes are made to your choices and are perishable, the 14-day cancellation period for orders made at a distance does not apply to them (Consumer Contracts Regulations 2013, regulation 28). If you cancel: [set your policy, e.g. “the deposit is refunded if you cancel at least 48 hours before collection; after that it is non-refundable because we will have bought ingredients and started work”].
If an order is not collected on the agreed day and we cannot reach you: [set your policy, e.g. “we keep it until closing time; the deposit is not refunded”].
If we have to cancel your order for a reason within our control, we will refund your deposit in full.
After collection
Our cakes are fresh, and many contain cream or mousse. Please keep them in the fridge, keep them upright and level when carrying them, and eat them within the time we give you on collection.
5. Table requests
You do not need a booking to visit. A table request is not confirmed until we call or email you to confirm it. If you are running late or need to cancel, please phone us so we can offer the table to someone else.
6. Allergens
Our food is made in one kitchen that handles allergens including cereals containing gluten, milk, eggs and nuts. Information about the 14 major allergens in each item is available from our staff — please ask before ordering, and tell us about any allergy when you order a cake. We cannot guarantee that any item is completely free from a particular allergen.
7. Your legal rights
Under the Consumer Rights Act 2015, the food we sell must be of satisfactory quality, as described and fit for purpose, and our services must be provided with reasonable care and skill. Nothing in these terms affects those rights. If something is wrong with your order, tell us as soon as you can and we will put it right. Citizens Advice can give free, independent advice on your rights.
8. Our responsibility to you
If we break these terms, we are responsible for loss or damage you suffer that is a foreseeable result of that. We are not responsible for losses that were not foreseeable, or for business losses, as our website and products are for personal use.
We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, for breaking your legal rights described in section 7, or for anything else the law does not allow us to limit.
9. Our content
The text, photographs, videos and design of this website belong to us or to the people who licensed them to us. The shopfront illustration is by Heavens to Betsy Illustrations. Please do not copy them for commercial use without asking. Links to other websites are for convenience; we are not responsible for their content.
10. Complaints and the law
If you have a complaint, please talk to us in the shop, phone 020 8852 5847 or email bonjour@ledelice.co.uk.
These terms are governed by the law of England and Wales, and you can bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
We may update these terms from time to time. The version on this page when you place your order is the one that applies to it.
